He is facing multiple criminal charges in Russia, including public calls for terrorism and justification of terrorism, related to posts in his Telegram channel, with one case stemming from content published not later than October 2024. Shpak has been sentenced in absentia to eight years in prison for spreading 'military fake news' and is currently reported to be living in Montenegro.
